After practising as a family lawyer for 17 years, a collaborative lawyer for 8 years and a mediator for 7 years I have seen the results that collaborative process options (i.e. collaborative law or mediation) can produce for a family rather than litigation.
I continue to practise as a consultant family solicitor for a Dorchester firm so I retain current legal and procedural knowledge albeit as a mediator; I do not provide legal advice, only legal information.
As a mediator I act as a neutral, independent party assisting both parties. I am not judging and the aim is to keep the session as future focused as possible and not to dwell on the past.
Where children are involved the focus is on keeping sessions child focused. I am trained to consult with children, if both parents consent, and I would then usually provide feedback to parents in advance of a joint mediation session. I have a recent criminal records check and have child friendly rooms available to undertake such consultations.
Mediation is one of the few areas where legal aid can still be secured after a financial means test only is undertaken. I am able to undertake legal aid assessments and can access legal aid for parties through my consultancy partnership with other mediation organisations.
I have been awarded the Help and Support for Separated Families Mark as a result of standards evidenced by my service.
Many couples state that they wish to remain as amicable as possible when separating and to achieve a solution in a timely and cost effective manner for the benefit of the whole family and mediation can achieve all of these objectives.
